CONDITIONS OF PARTICIPATION
The Conditions of Participation are also available in German.
With the conditions of participation we want to protect not only us, but also you. Please take the time to read them in detail!
Conditions of participation 04.11.22
You can participate if you are at least 18 years old.
By participating in the project, you agree that your poster, your name and, if applicable, the web link to your website and your social media contact will be published on Design Democracy, the social media linked to it, at events, publications or in the promotional material of Design Democracy, as well as, if applicable, on external websites that link to Design Democracy or cooperate with the project.
On our website, your name will appear in three places:
1. on the homepage on the list of "Designers for Democratic Values" as a supporter:in of the project,
2. on your personal poster page, and
3. in the feature if your poster is selected as one of the winning posters.
If your poster is shared on social media by Design Democracy and possibly by external site visitors, your name will also be included.
The web link to your website will be published on our website on your personal poster page and only if you provide it.
Your email address will be saved, but will not be published at any time and will not be given to third parties without your consent.
By entering, you agree to have your name & web link published as shown above.
Please state your first and last name when entering, you may not use synonyms. As an exception, in the case of a joint design of a poster, this association of several designers may also include the name of the collective or design office in the submission. You are responsible for the accuracy of the contact information provided.
All personal data must be true. Otherwise Design Democracy may exclude you from participation at any time. If there is any reason why you can not participate with your own name, please send us an E-Mail along with your entry informing us about this instance.
You may not submit entries on behalf of another person unless that person has specifically asked you to do so. We reserve the right to ask questions about the data you have submitted, should there be any suspicion of misrepresentation or copyright infringement.
By uploading you confirm that you are the author of the uploaded poster and that you have unrestricted rights of use to the poster and that the posters are free of third party rights. It is your responsibility to ensure that your Poster does not in any way infringe the copyrights, trademark rights, property rights or personal rights of any third party. In the event of infringement, you will indemnify us in respect of any royalties, damages or other amounts due to third parties.
With the upload you donate your poster to Design Democracy and transfer a non-exclusive, temporally, spatially and contentwise unrestricted, irrevocable right of use, as well as the temporally, spatially and contentwise unrestricted and irrevocable right to digital & physical reproductions of the motif to Design Democracy and our cooperation partners. You also grant us the right to use your motif for advertising purposes and to generate donations for the project.
The copyrights of the poster remain at all times with the designer, who will be mentioned by name in every context. Every submission that is used by us as described above will be made with mention of the designer.
Should it occur in individual cases that a naming is not done correctly, this does not immediately lead to a breach of contract, as long as all necessary measures are taken to correct this error within a reasonable period of time from the time of knowledge.
We reserve the right not to publish or subsequently remove contributions from the website that violate our mission statement or do not meet our internal evaluation criteria for posters without explaining the reasons and without further notice.
Participants can subsequently edit and delete the data they have provided as well as submitted posters. A link for this will be sent to the designer by e-mail after the upload. A revision or deletion does not affect the transferred right of use and the right of reproduction. If the motif changes during the revision, the right of use is also valid for subsequently transmitted motifs as granted.
We reserve the right in exceptional cases to edit the title, description text & hashtag selection of the submitted posters to ensure the best possible function of the website and the project.
In special cases, designs can also be submitted by e-mail instead of using the entry form. We offer this service especially if the operation of the participation form by the designer is not possible due to language barriers.
If this applies to you, please send us an email with your poster as JPG or GIF, max. 3MB, min. 1200 px wide. Please send us your full name and email address. You can also include your website and Instagram and Twitter handle to be linked on social media when your poster is published. Also, provide a title for your poster and send us a description text of at least 200 characters. You can also indicate which topic your poster is related to. If you do not provide a title, description and topic, we will add this information on your behalf. We are not obligated to agree with you before publishing your poster, but we will always try to get your permission first.
We reserve the right to request a higher resolution version of your submitted poster at a later date, for example if the project is developed further in the direction of print or is to be published in a print publication.
For the submission of one or more posters, as well as their publication in any form, no fees or compensation will be paid by Design Democracy to the designers.
The Participation in the Design Democracy competition is free of charge for the designers, regardless of the number of posters entered.
All submitted posters will be entered into a competition. The winners of the poster competition will be determined by the click votes on the website in the given voting period. For the three winning posters of each voting period, a prize in the form of an online advertising budget is provided, which will be used to promote the winning posters online (e.g. Facebook, Instagram, ...) as part of Design Democracy. These ads are targeted towards politically conservatives and sympathizers of right-wing populist. The purpose is to distribute a counter narrative to conspiracy theories and hate speech. Due to the target group and the partly emotional discussions, the name of the designer is not mentioned in this ad to protect her:him. If the designer wants his or her name to appear in this ad, he or she is obliged to inform Design Democracy of this wish independently and without being asked to do so.
The winners will be informed by email in German.
The placement of the ads will be conducted by Design Democracy. The winners have no right of co-determination in the creation and placement of the ads. Design Democracy does not have to provide the winners with proof of the placement of the ads.
The first place winner will also win a physical gift, which will be sent to him:her by Design Democracy, i.e. a book. This assumes that he:she will provide his:her address information after being notified of the prize. The shipping of the prize is only possible within Germany, Austria and Switzerland due to shipping costs, taxes and the prices often being books using German language. If the winner provides us with an address outside of the here named countries, we reserve the right to refuse shipment of the prize.
We reserve the right to shorten, extend, modify, postpone, cancel, suspend or terminate the contest, in whole or in part, at any time without notice and without giving reasons. Likewise, we reserve the right to adjust or suspend the budget for the advertisement without prior notice and without giving reasons.
Design Democracy will make use of these possibilities especially if for legal or financial reasons a proper execution of the competition cannot be guaranteed.
We reserve the right to exclude a designer from participation in the competition until the announcement of the winners or subsequently for important reasons. The participants have no claim to the winnings, even if a winner has already been announced. The prize amount cannot be paid in cash to the winners. The prize is not transferable. The legal process is excluded. The liability of Design Democracy in connection with the implementation of the competition, for whatever legal reason, is excluded.
If there are no clear winners from the click votes, because several posters have received the same number of clicks, the Design Democracy team will make the final selection of the winning posters based on our internal evaluation criteria.
Team members of Design Democracy are not generally excluded from participating with posters in the project, but will not be considered in the evaluation of the winners in order to exclude a preference in self-interest.
We reserve the right to change or modify the Terms and Conditions from time to time in our sole discretion. We will notify you of changes by updating the "last updated" date of these Terms of Service. You waive the right to be notified separately of any such change. Please be sure to review the applicable Terms each time you use our Site so that you understand which Terms apply. Your continued use of the Website after the date of posting of the revised Terms of Participation will subject you to them and you will be deemed to have acknowledged and accepted the changes in the revised Terms of Participation.
If individual provisions of these terms and conditions are invalid or a loophole exists, this does not affect the validity of the remaining provisions. The invalid or missing provision will be replaced by a valid provision that comes closest to the purpose of the contract.
